These Terms of Use and Sale (the “Terms”) govern your access to and use of https://rmvd.com and any related pages, content, customer accounts, communications, products, and services operated by RMVD LLC (“RMVD,” “we,” “us,” or “our”) (collectively, the “Services”). These Terms also apply to purchases of RMVD products, including one-time purchases and subscriptions.

By accessing the Services, creating an account, or placing an order, you agree to these Terms, our Privacy Policy, Subscription and Automatic Renewal Terms, Refund and Return Policy, Shipping and Delivery Policy, and any additional terms presented at checkout. If you do not agree, do not use the Services.

1. Eligibility and Intended Use

You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services or purchase products. RMVD products are intended for personal, lawful use and not for resale unless we authorize resale in writing.

2. Dietary Supplement and Medical Information

RMVD products are dietary supplements, not drugs. Content on the Services is provided for general educational and informational purposes only and is not medical advice, diagnosis, or treatment. Always read and follow the product label and consult a qualified healthcare professional before using any dietary supplement, particularly if you are pregnant or nursing, have a medical condition, take medication, are planning surgery, or have allergies.

ALLERGEN NOTICE: RMVD Microplastic Protocol Support contains chitosan made from shrimp shell. Contains: Crustacean Shellfish (Shrimp). Do not use it if you have a shellfish allergy. Confirm the allergen statement on the product label before use.

Statements about dietary supplements have not necessarily been evaluated by the Food and Drug Administration. RMVD products are not intended to diagnose, treat, cure, or prevent any disease. Additional limitations appear in our Medical and Dietary Supplement Disclaimer, which is incorporated into these Terms.

3. Product Information and Availability

We try to describe and display products accurately, but packaging, color, capsule appearance, ingredient sourcing, specifications, and other details may change. Images are illustrative and may vary from the product received. We may limit quantities, discontinue products, correct errors, or refuse or cancel an order when reasonably necessary, including for suspected fraud, misuse, resale, pricing errors, inventory shortages, or legal compliance.

Any research, studies, ingredient information, or customer experiences referenced on the Services do not guarantee that you will obtain the same or any particular result. Individual results vary.

4. Accounts and Information You Provide

You are responsible for maintaining the confidentiality of your account credentials and for activity under your account. You agree to provide accurate, current, and complete account, billing, and shipping information and to promptly update that information. Notify us at support@rmvd.com if you believe your account or payment information has been used without authorization.

5. Orders and Acceptance

Your order is an offer to purchase. We may accept or reject an order in our discretion, subject to applicable law. An order-confirmation message acknowledges receipt but does not necessarily constitute acceptance. Acceptance occurs when we ship the product or otherwise confirm acceptance. If we cancel an order after payment, we will refund the amount charged for the canceled portion.

6. Prices, Taxes, Promotions, and Payment

• Prices are displayed in the currency shown at checkout and may change at any time before purchase.

• Applicable taxes, shipping charges, duties, and fees are shown at checkout when reasonably determinable.

• Promotional offers may have additional terms, expiration dates, eligibility limits, or quantity restrictions. Unless stated otherwise, promotions cannot be combined and have no cash value.

• You authorize RMVD and its payment processors to charge the payment method you provide for your order, including recurring charges when you select a subscription.

• If a payment is declined or reversed, we may retry the payment, request another payment method, delay shipment, suspend a subscription, or cancel the order.

7. One-Time Purchases and Subscriptions

RMVD offers one-time purchases and automatically renewing subscriptions. Some offers are available only as a subscription. Subscription purchases (Autoship) renew on the schedule selected at checkout, for example every 30, 45, 90 or 150 days, until canceled or changed. The price, frequency, quantity, shipping charges, taxes, cancellation method, and any introductory or promotional terms will be presented before you submit the order. Subscription purchases are also governed by our Subscription and Automatic Renewal Terms.

8. Shipping, Delivery, and Risk of Loss

Shipping and delivery are governed by our Shipping and Delivery Policy. Delivery dates are estimates and may be affected by carrier delays, weather, address errors, customs, inventory, and other circumstances outside our control. You are responsible for providing a complete and accurate delivery address. Risk of loss passes to you when the carrier records delivery, except where applicable law requires otherwise.

9. Returns, Refunds, and Guarantee

Returns, refunds, replacements, and the RMVD 60-Day Guarantee are governed by our Refund, Return, and 60-Day Guarantee Policy. The guarantee applies only as expressly stated in that policy and does not promise a particular health outcome.

10. Intellectual Property

The Services and all associated content—including the RMVD name, logos, product names, designs, text, photographs, video, graphics, software, and compilations—are owned by RMVD or its licensors and protected by intellectual-property laws. RMVD grants you a limited, revocable, nonexclusive, nontransferable license to access and use the Services for personal, noncommercial purposes. You may not copy, reproduce, modify, distribute, scrape, frame, republish, sell, reverse engineer, or exploit the Services or content without prior written permission, except as allowed by law.

11. Reviews, Testimonials, and User Content

If you submit a review, photograph, video, testimonial, comment, question, or other content (“User Content”), you represent that it is truthful, based on your genuine experience, does not violate another person’s rights, and does not contain unlawful, misleading, defamatory, obscene, or confidential material. You grant RMVD a worldwide, nonexclusive, royalty-free, sublicensable license to host, reproduce, display, adapt, and use the User Content to operate and promote the Services, subject to applicable law and any separate release you sign.

We may moderate or remove User Content, but we are not obligated to do so. Compensation, discounts, free products, employment, ownership, or other material connections to RMVD must be clearly disclosed in any endorsement.

12. Prohibited Conduct

• Using the Services for unlawful, fraudulent, abusive, deceptive, or harmful purposes;

• Attempting to gain unauthorized access to accounts, systems, data, or networks;

• Introducing malware, automated attacks, excessive requests, or technology intended to disrupt the Services;

• Using bots, scrapers, or automated means to copy content, collect data, monitor inventory, or make purchases without written permission;

• Impersonating another person, submitting false information, or using another person’s payment method without permission;

• Reselling RMVD products through unauthorized marketplaces or making unauthorized disease, medical, or performance claims about RMVD products;

• Interfering with security features, notices, or technological protections.

13. Third-Party Services and Links

The Services may use or link to third-party services, including Shopify, payment processors, subscription-management platforms, fulfillment providers, carriers, analytics providers, advertising networks, review platforms, and social networks. Third-party services are governed by their own terms and privacy practices. RMVD is not responsible for third-party content, availability, security, or conduct, except as required by law.

14. Privacy and Electronic Communications

Our collection and use of personal information are described in our Privacy Policy. Transactional communications regarding orders, subscriptions, accounts, security, returns, and service are part of the Services. Marketing email and text messages are optional and may be stopped using the unsubscribe or opt-out method provided in the communication.

15. Disclaimer of Warranties

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES AND PRODUCTS ARE PROVIDED “AS IS” AND “AS AVAILABLE.” RMVD DISCLAIMS ALL WARRANTIES NOT EXPRESSLY STATED IN WRITING, INCLUDING IMPLIED WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, AND NON-INFRINGEMENT. RMVD DOES NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, SECURE, OR FREE OF HARMFUL COMPONENTS, OR THAT A PRODUCT WILL PRODUCE A PARTICULAR RESULT. Some jurisdictions do not permit certain warranty disclaimers, so portions of this section may not apply to you.

16. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RMVD AND ITS MEMBERS, MANAGERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, REVENUE, DATA, GOODWILL, OR BUSINESS OPPORTUNITY, ARISING FROM OR RELATED TO THE SERVICES OR PRODUCTS, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, RMVD’S TOTAL LIABILITY FOR A CLAIM ARISING FROM A PRODUCT OR TRANSACTION WILL NOT EXCEED THE AMOUNT YOU PAID TO RMVD FOR THE PRODUCT OR TRANSACTION GIVING RISE TO THE CLAIM DURING THE SIX MONTHS BEFORE THE EVENT. These limitations do not exclude liability that cannot lawfully be limited, including liability for fraud, willful misconduct, or personal injury caused by negligence where the law prohibits limitation.

17. Indemnification

To the extent permitted by law, you agree to indemnify and hold harmless RMVD and its affiliates, personnel, and service providers from third-party claims, losses, liabilities, and reasonable expenses arising from your unlawful misuse of the Services, violation of these Terms, infringement of another person’s rights, unauthorized resale, or false or unlawful claims you make about RMVD products.

18. Governing Law and Disputes

These Terms are governed by the laws of the State of Wisconsin, without regard to conflict-of-law rules, except to the extent the consumer-protection laws of your state cannot lawfully be waived. Before filing a lawsuit, you and RMVD agree to attempt in good faith to resolve the dispute by sending a written notice describing the issue and requested resolution. Notices to RMVD must be sent to legal@rmvd.com and the postal address below.

Unless applicable law permits or requires another location, exclusive jurisdiction and venue for disputes will lie in the state or federal courts serving Winnebago County, Wisconsin. Either party may bring an eligible claim in small-claims court.

19. Changes and Termination

We may update these Terms prospectively by posting a revised version and changing the “Last Updated” date. Material changes will be communicated when required by law. We may suspend or terminate access to the Services for conduct that violates these Terms or creates legal, security, or operational risk. Provisions that by their nature should survive termination will survive.

20. Miscellaneous

If any provision of these Terms is held unenforceable, it will be limited or removed to the minimum extent necessary and the remaining provisions will remain in effect. Our failure to enforce a provision is not a waiver. These Terms and incorporated policies form the entire agreement regarding the Services and supersede prior or contemporaneous communications on the same subject. You may not assign these Terms without our written consent; RMVD may assign them as part of a merger, financing, reorganization, sale, or transfer of assets.
